Neither of these dynamics is politically healthy. The task of legislators is not to posture in order to provoke jurists who are actually in charge. Rather, legislators’ job is to legislate and, crucially, to be accountable for it. They are not accountable for that which no one actually believes will occur, especially when the reason is that judges will not permit it. Nor is it politically healthy for the Court to shelter one side’s absolute position while disenfranchising the other’s.

Why did justice Clarence Thomas write so much on eugenics?

"We denounce eugenics in all forms for the same reason we are working to fight abortion bans across the country," said Melanie Newman, senior vice president of communications and culture for Planned Parenthood Federation of America. "Every person should have the freedom to make their own decisions about their body."
What is funny is that Marxist philosopher Jürgen Habermas took a similar stance on abortion rights, because he feared what would be a liberal kind of eugenics, leading towards a way of thinking that a too-liberal ruling on abortions would open doors for parents towards aborting fetuses that suffered from disabilities, or chronic illnesses. Mr. Thomas is not completely wrong on this, it's true.
"In arguing that Indiana's law that bans abortion based solely on race, disability or sex, could one day pass legal muster, Thomas is harkening back to the eugenics movement of the early 20th century," she said.

It seems leftists are really having a fit over this whole Alabama abortion thing.

I find the whole situation amusing on several levels. There is the usual surface level fake outrage and internet virtue signaling, the Alyssa Milano led "sex strike" is an especially comical example of this.

Yet there is also this whole meta level to it that I see, a kind of reversal. What are the long term implications of a conservative led ban on abortions? (Well, one would hope that it would force women to be more careful, but that doesn't seem very likely to me.) I would expect that the amount of unwanted births would increase. Resulting in more delinquency, crime, more welfare dependents and more Democrat voters. It seems to me the long term effects of this very conservative type legislation would ultimately lead to a decline of conservatism in the long run. It's a bit ironic isn't it?... show more

11-year old rape victim unable to receive abortion due to heartbeat bill

In an email to CBS News, the Ohio Attorney General Dave Yost defended the statute when asked if the law would apply in this circumstance. "Sometimes, the evolution of the law requires bold steps," Yost wrote. "In the last 46 years, the practice of medicine has changed. Science has changed. Even the point of viability has changed. Only the law has lagged behind."
It lacks behind right now. Ohio has gone back in time, especially in terms of women's suffrage. The relation to The Handmaid's Tale appears sadly apparent.

When evangelicals were pro-choice
So it was only in my lifetime that #Evangelicals became #ProLife. Before Jerry Falwell (the disgraced preacher) they were #ProChoice.
